Joaquin Castro (D-Texas) and state Sen. Roland Gutierrez (D-San Antonio), who is running for U.S. Senate, both issued statements via their official accounts on X, the social media site better known as Twitter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawmakers\u2019 remarks came after <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2023\/08\/29\/texas-guardsmen-spied-on-migrants-via-whatsapp-mishandled-secret-docs\/\" target=\"_blank\">an investigation published Tuesday by Military Times and The Texas Tribune<\/a> revealed how Texas Guardsmen at the state\u2019s border with Mexico spied on migrants via WhatsApp and allegedly mishandled secret documents. At least three internal whistleblowers independently reported their peers\u2019 actions to watchdogs, sparking an investigation that ultimately led the state to disband the border mission\u2019s intelligence directorate in fall 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Texas National Guard inspector general faulted at least two officers for the WhatsApp work, and at least four have faced interim administrative discipline. Two officers implicated in the operation told Military Times and the Tribune that the state failed to give them clear guidance on what intelligence work was allowed, and they also claimed their commanders \u2014 now-retired Col. Kevin Boates and Brig. Gen. Monie Ulis \u2014 disregarded concerns raised by oversight personnel.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/staging.sightlinemg.com\/armytimes\/news\/your-army\/2023\/08\/29\/texas-guardsmen-spied-on-migrants-via-whatsapp-mishandled-secret-docs\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/staging.sightlinemg.com\/wp-content\/uploads\/2026\/08\/WhatsAppOnBorder.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Texas Guardsmen spied on migrants via WhatsApp, mishandled secret docs<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">An investigation by Military Times and The Texas Tribune charts the rise and fall of a military intelligence directorate gone rogue on the border.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201c[Gov. Greg] Abbott\u2019s officials pushed National Guard troops to misuse federal resources for a state-sponsored spy ring &amp; punished officers who raised concerns,\u201d Castro, a member of the House Intelligence Committee, <a href=\"https:\/\/twitter.com\/JoaquinCastrotx\/status\/1696561149108531606\" target=\"_blank\">said<\/a>. \u201cWe need a full federal investigation or this incident will set a dangerous precedent for domestic surveillance of U.S. citizens.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abbott\u2019s office did not immediately provide a comment for this story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gutierrez, an immigration attorney outside of political life, <a href=\"https:\/\/twitter.com\/RolandForTexas\/status\/1696655933240234074\" target=\"_blank\">argued<\/a> the intelligence operation was \u201cunconstitutional\u201d and said \u201cthere must be a full [Justice Department] investigation&#8230;with swift action and accountability.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Castro and Gutierrez\u2019s worries echo those of troops familiar with the intelligence operations who spoke to Military Times on condition of anonymity because they feared retaliation from state officials. Those service members said they were worried that without clearer policies and guidance in place, governors around the country may abuse their state authority over the Guard to deploy their federally-trained intelligence personnel for dubious missions to enforce politically controversial laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One soldier said he welcomed the call for a federal investigation, adding that he hopes such scrutiny would help the government develop \u201cclearer&#8230;instructions and guidelines\u201d for intelligence operations under state authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Justice Department were to launch an investigation of Operation Lone Star\u2019s intelligence work, it would be at least the third federal probe of the state-run border mission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Texas Tribune and ProPublica <a href=\"https:\/\/www.texastribune.org\/2022\/07\/06\/operation-lone-star-doj-investigation-abbott\/\" target=\"_blank\">reported in July 2022<\/a> that the Justice Department\u2019s civil rights division was investigating whether the state\u2019s trespassing arrests of migrants violated federal civil rights laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The federal government also <a href=\"https:\/\/www.texastribune.org\/2023\/08\/22\/texas-border-barrier-justice-department-court-hearing\/\" target=\"_blank\">sued Texas for placing floating barriers<\/a> in the Rio Grande in July. Mexico\u2019s government claimed the buoys violated treaties that govern the international border, and the Justice Department claimed Texas was not authorized to install the barrier.
