{"id":22515,"date":"2021-11-23T18:48:58","date_gmt":"2021-11-23T18:48:58","guid":{"rendered":"https:\/\/staging.sightlinemg.com\/federaltimes\/uncategorized\/2021\/11\/23\/new-bill-codifies-opm-role-in-federal-employee-policy\/"},"modified":"2026-08-08T04:55:24","modified_gmt":"2026-08-08T04:55:24","slug":"new-bill-codifies-opm-role-in-federal-employee-policy","status":"publish","type":"post","link":"https:\/\/staging.sightlinemg.com\/federaltimes\/management\/2021\/11\/23\/new-bill-codifies-opm-role-in-federal-employee-policy\/","title":{"rendered":"New bill codifies OPM role in federal employee policy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Legislation introduced in the House Tuesday would not only establish credentials necessary for all future Office of Personnel Management directors, but also formally dictate the agency\u2019s role in leading human resources through data-driven and modern policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the bill, introduced by Rep. Gerry Connolly, D-Va., a nominee for OPM director would have to have prior human capital experience and be chosen without regard for political affiliation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The president would also have to provide Congress with written rationale for any decision to remove a Senate-confirmed director. That requirement mirrors similar language in <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/congress\/2021\/05\/03\/slate-of-bills-to-protect-feds-and-transparency-considered-in-committee\/\" target=\"_blank\">pending inspector general legislation<\/a> that would push the president to provide more substantive cause for removing a watchdog official.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the legislation would also outline in U.S. Code that OPM is the designated agency to \u201censure the proper application of merit system principles for all Federal civilian human resource systems and employees.\u201d Current law only dictates that OPM is an independent agency, with a seal and headquarters in Washington, D.C.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That existing vague definition of the agency left open a path for the Trump administration to <a href=\"https:\/\/www.federaltimes.com\/management\/2018\/06\/21\/whats-inside-trumps-major-government-overhaul\/\" target=\"_blank\">attempt to transfer many of OPM\u2019s authorities<\/a> to the General Services Administration and the Executive Office of the President, a move that was <a href=\"https:\/\/www.federaltimes.com\/management\/2019\/08\/22\/democratic-leader-opmgsa-merger-not-going-to-happen\/\" target=\"_blank\">resoundingly criticized<\/a> and eventually blocked by Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe successfully stopped the previous administration from abolishing OPM, now we have a responsibility to rebuild and modernize this agency,\u201d Connolly said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFederal employees are the crown jewel of government, and we must build a human resources agency nimble and prepared to help us attract and retain the talent our nation needs to provide vital services today and into the future.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bill would also ensure a continuity of expertise at OPM by establishing a career chief management officer position responsible for advising the director and aligning policies across the agency with its overall mission. Such a position could prove essential if the <a href=\"https:\/\/www.federaltimes.com\/management\/leadership\/2021\/01\/21\/mcgettigan-to-once-again-take-up-temporary-personnel-leadership\/\" target=\"_blank\">high turnover rate of agency directors <\/a>over the past few years continues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Directors will also appoint an advisory committee made up of members of the public sector, private sector, academia and federal employee organizations to explore new human capital strategies and best practices. This committee would report to both the OPM Director and Congress annually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe legislation \u2014 cosponsored by Representatives Brian Fitzpatrick, R-PA, and Carolyn Maloney, D-N.Y. \u2014 would implement some <a href=\"https:\/\/www.federaltimes.com\/management\/2021\/03\/17\/congressionally-mandated-report-envisions-a-more-powerful-opm\/\" target=\"_blank\">key legislative recommendations<\/a> made in the National Academy of Public Administration\u2019s report \u2018Elevating Human Capital: Reframing the U.S. Office of Personnel Management\u2019s Leadership Imperative,\u2019 released in March,\u201d said Ken Thomas, national president for the National Active and Retired Federal Employees Association, in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese recommendations are long overdue, and it\u2019s heartening to see Chairman Connolly\u2019s leadership in following through and
