{"id":24768,"date":"2022-11-23T16:57:54","date_gmt":"2022-11-23T16:57:54","guid":{"rendered":"https:\/\/staging.sightlinemg.com\/federaltimes\/uncategorized\/2022\/11\/23\/veterans-affairs-dept-discloses-breach-of-employee-vaccine-data\/"},"modified":"2026-08-08T04:59:08","modified_gmt":"2026-08-08T04:59:08","slug":"veterans-affairs-dept-discloses-breach-of-employee-vaccine-data","status":"publish","type":"post","link":"https:\/\/staging.sightlinemg.com\/federaltimes\/management\/hr\/2022\/11\/23\/veterans-affairs-dept-discloses-breach-of-employee-vaccine-data\/","title":{"rendered":"Veterans Affairs Dept. discloses breach of employee vaccine data"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 The U.S. Department of Veterans Affairs said sensitive personal information concerning employees\u2019 vaccination status was improperly disclosed last fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following an investigation by the department\u2019s Data Breach Response Service, the agency removed a spreadsheet containing personnel details, according to a notice sent to the agency\u2019s bargaining unit employees that was obtained by Federal Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUpon internal review, the VA agrees that the information contained in these documents should not have been placed on SharePoint without appropriate access permissions and this incident resulted in the inadvertent or unauthorized transmissions or disclosure of sensitive personal information,\u201d it said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A VA spokesperson did not immediately respond to emailed requests for comment. The notice said that agency will complete any additional required investigations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data included employees\u2019 names and whether or not they had been vaccinated or exempted, according to the American Federation of Government Employee\u2019s National VA Council, which <a href=\"http:\/\/afgenvac.org\/wp-content\/uploads\/2021\/11\/NG-10-27-2021-COVID-19-Vaccination-Status-Disclosure.pdf\" target=\"_blank\">filed a grievance. <\/a>About <a href=\"https:\/\/www.afge.org\/article\/another-afge-win-va-to-comply-with-privacy-laws-protecting-employees-records-of-covid19-vaccination-status\/\" target=\"_blank\">500,000 employees\u2019<\/a> records of vaccination status were disclosed without permission and were sent to various members of Veterans Health Administration senior leadership, the union said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The information did not show the basis for which an exception was granted to the agency\u2019s <a href=\"https:\/\/www.va.gov\/files\/2022-08\/OCHCO%20Bulletin%20-%20Policy%20Notice%20-%20Mandatory%20COVID-19%20Vaccination%20Program%20for%20all%20VA%20Employees.pdf\" target=\"_blank\">vaccine mandate<\/a>, whether for medical or religious reasons, said Sarah Hasan, an NVAC attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe knew they were collecting this information, but we didn\u2019t realize that they were actually pulling it and aggregating it for senior staff to inform them who was vaccinated [and] who was not vaccinated,\u201d she told Federal Times in an interview.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The union alleged that many recipients did not need to be privy to this information and that employees did not give express written consent beforehand, constituting a Privacy Act violation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hasan said that the links to the files were live for about two hours before the VA took them down, but anyone who had received the email or had a link to that SharePoint site was able to view the data, whether from a home or work computer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s not that they can\u2019t collect this information necessarily, or that they can\u2019t disclose it to certain individuals,\u201d Hasan said. \u201cBut it was just the the scope of the disclosure, it
