{"id":25047,"date":"2023-01-17T20:31:27","date_gmt":"2023-01-17T20:31:27","guid":{"rendered":"https:\/\/staging.sightlinemg.com\/federaltimes\/uncategorized\/2023\/01\/17\/white-house-memo-establishes-labor-advisors-on-federal-contracts\/"},"modified":"2026-08-08T05:05:39","modified_gmt":"2026-08-08T05:05:39","slug":"white-house-memo-establishes-labor-advisors-on-federal-contracts","status":"publish","type":"post","link":"https:\/\/staging.sightlinemg.com\/federaltimes\/acquisition\/regulations\/2023\/01\/17\/white-house-memo-establishes-labor-advisors-on-federal-contracts\/","title":{"rendered":"White House memo establishes labor advisers on federal contracts"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The White House is requiring federal agencies to formally designate a labor adviser who will ensure government contracts are complying with federal employment law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Agency labor advisers are subject-matter experts on contract and labor rules, though not every agency has one, nor has there been uniform support for training these positions, according to a <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2023\/01\/M-23-08-Labor-Advisor.pdf\" target=\"_blank\">memo<\/a> issued Jan. 10 by the White House Office of Management and Budget. That\u2019s why OMB, in partnership with the Department of Labor, is requiring the two-dozen largest agencies to designate at least one career employee as a labor adviser by Feb. 15 if they don\u2019t already have one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidance adds another layer of <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/09\/08\/remarks-by-president-biden-in-honor-of-labor-unions\/\" target=\"_blank\">pro-labor policy<\/a> to the Biden administration\u2019s approach to its workforce, which is comprised of 2.2 million federal civilian employees and nearly 5 million outside of government who work on contracts, according to Brookings Institute <a href=\"https:\/\/www.brookings.edu\/blog\/fixgov\/2020\/10\/07\/the-true-size-of-government-is-nearing-a-record-high\/\" target=\"_blank\">projections<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The goal is for labor advisers to help agencies avoid employment violations that can result in costly backpay, lawsuits and erosion of trust in the $600 billion federal procurement system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A <a href=\"https:\/\/www.gao.gov\/assets\/gao-21-11.pdf\" target=\"_blank\">2020 watchdog report<\/a> from the Government Accountability Office found that despite a long list of employee protections enumerated in federal labor and contract law, there were violations of wage or benefit protections in nearly 70% of Service Contract Act cases spanning a five-year period. That resulted in contractors agreeing to pay approximately $224 million in back wages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seven years earlier, the Senate found that <a href=\"https:\/\/www.help.senate.gov\/imo\/media\/doc\/Labor%20Law%20Violations%20by%20Contractors%20Report.pdf\" target=\"_blank\">almost 30% <\/a>of the top violators of federal wage and safety laws were federal contractors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both reports attributed at least some of the transgressions to a lack of clear information provided by the Department of Labor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cContracting officers still lack clear standards that would allow them to interpret the meaning of violations of federal labor law, and therefore do not undertake a formal or standardized process in evaluating a prospective contractor\u2019s compliance with federal labor law prior to awarding a contract,\u201d said the Senate\u2019s 2013<a href=\"https:\/\/www.help.senate.gov\/imo\/media\/doc\/Labor%20Law%20Violations%20by%20Contractors%20Report.pdf\" target=\"_blank\"> report. <\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new OMB guidance aims to bridge information gap by supporting labor advisers as liaisons who have the legal expertise to identify burgeoning labor violations before they erupt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Department of Labor is expected to train new labor advisers and provide technical assistance. The department will also form a group with help from OMB\u2019s Office of Federal Procurement Policy that will meet regularly as a sounding board for advisers and other acquisition professionals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Immediate priorities include training on predecessor contract hiring, project labor agreements and promoting labor peace, the memo
