{"id":25518,"date":"2020-06-18T19:16:09","date_gmt":"2020-06-18T19:16:09","guid":{"rendered":"https:\/\/staging.sightlinemg.com\/federaltimes\/uncategorized\/2020\/06\/18\/retired-dea-agents-say-agency-has-legacy-of-discrimination\/"},"modified":"2026-08-08T05:02:51","modified_gmt":"2026-08-08T05:02:51","slug":"retired-dea-agents-say-agency-has-legacy-of-discrimination","status":"publish","type":"post","link":"https:\/\/staging.sightlinemg.com\/federaltimes\/management\/2020\/06\/18\/retired-dea-agents-say-agency-has-legacy-of-discrimination\/","title":{"rendered":"Retired DEA agents say agency has legacy of discrimination"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">NEW YORK \u2014 Dozens of retired black narcotics agents say their former agency, the U.S. Drug Enforcement Administration, has discriminated against its African American employees for decades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The group of retired agents said in a statement sent to news organizations this week that Attorney General William Barr was out of touch with racial disparities that permeate not only local police departments but federal law enforcement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is a culture,\u201d said Karl Colder, who previously oversaw the DEA\u2019s Washington field division, served on the agency\u2019s diversity committee and was one of 76 former agents involved in drafting the statement. \u201cYou still don\u2019t have African Americans in positions to really monitor and ensure things are equal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The former agents pointed to a court ruling last year that said the DEA has failed to even the playing field for black agents <a href=\"https:\/\/www.federaltimes.com\/management\/hr\/2019\/11\/18\/the-administration-aims-to-up-federal-diversity-cut-poor-performers\/\" target=_blank>seeking promotions<\/a>.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/staging.sightlinemg.com\/federaltimes\/management\/hr\/2019\/08\/01\/how-the-intelligence-communitys-plan-to-increase-diversity-falls-short\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/staging.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-611169662-Cropped.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Is the intelligence community\u2019s plan to increase diversity useful?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The intelligence community&#039;s education grant program lacks the data to prove whether it&#039;s working, the Government Accountability Office found.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The little-noticed ruling put the DEA on the hook for millions of dollars in back pay and attorneys\u2019 fees in a civil rights lawsuit dating to 1977 \u2014 just four years after the agency\u2019s founding. It also extended judicial oversight of DEA\u2019s promotion practices and drew fresh attention to the <a href=\"https:\/\/www.federaltimes.com\/management\/hr\/2020\/02\/25\/state-department-struggles-with-diversity-especially-in-leadership\/\" target=_blank>lack of diversity<\/a> within its senior leadership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barr recently told CBS he does not \u201cthink that the law enforcement system is systemically racist.\u201d The retired agents disagreed, saying that \u201csystemic racism has ended aspirations, careers and in some cases even lives.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUnfortunately, it has taken the despicable killing of George Floyd to awaken the collective conscience of the American people,\u201d the retired agents wrote, referring to the police killing in Minneapolis. \u201cFor the highest-ranking law enforcement officer in the country to be blinded to this notion is inconceivable and will continue to have detrimental consequences.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A spokeswoman for Barr deferred comment to the DEA, which said it was precluded from commenting about \u201cspecific allegations\u201d in light of the ongoing civil rights litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DEA said in a statement that its policies \u201cmake clear that racism and discrimination will not be tolerated.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDEA is committed to recruiting, retaining and promoting a workforce that reflects the diversity of our country and the people we serve,\u201d the agency said. \u201cThat diversity is our strength and enables us to fulfill the responsibility entrusted to us by the American people to fairly and equally enforce the rule of law.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Federal law enforcement agencies have long struggled to diversify their ranks, and it often has taken court intervention to address discriminatory hiring and promoting practices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Former FBI Director James Comey said in 2018 that the bureau\u2019s lack of diversity had become \u201ca crisis\u201d for an agency that agreed nearly two decades ago to overhaul its promotion and disciplinary procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The civil rights case against the DEA has dragged on for decades despite a series of court orders governing the agency\u2019s hiring and promotion practices. Black people still account for just 8% of the agency\u2019s more than 4,000 special agents, according to court records, while more than 77% are white.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re in a unique position of being black and blue,\u201d said June Rogers, who previously led the DEA\u2019s New England field office. \u201cI\u2019m really glad we\u2019re at a point now where people are listening, but in order for us to change things, we\u2019ve got to change minds and hearts.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DEA was first held liable in the early 1980s for discriminating against black agents in salary, promotions, supervisory evaluations and discipline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last year, a federal judge in Washington ruled the DEA had run afoul of court orders intended to remove the subjectivity from the agency\u2019s promotion process. U.S. District Judge Emmet G. Sullivan reiterated that the agency owes damages to black agents whose careers were affected by what he called an \u201cunlawful selection device.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attorneys for the black agents said they are still trying to determine how much money the DEA owes their clients. The DEA also could owe as much as $12 million in attorneys\u2019 fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A half dozen retired black agents told AP that the \u201cgood ol\u2019 boy\u201d mentality is so entrenched at the DEA that it persisted even under black attorneys general Eric Holder and Loretta Lynch. They recalled colleagues who faced retaliation and exile for speaking out, and said the agency\u2019s failure to diversify has hampered its ability to build trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe only way it\u2019s going to change is for the complete mindset to change,\u201d said Ernest Howard, former special agent in charge of the DEA\u2019s Houston
