{"id":25560,"date":"2023-02-24T15:57:15","date_gmt":"2023-02-24T15:57:15","guid":{"rendered":"https:\/\/staging.sightlinemg.com\/federaltimes\/uncategorized\/2023\/02\/24\/benefeds-contractor-pays-31m-in-back-wages-benefits-to-employees\/"},"modified":"2026-08-08T05:00:39","modified_gmt":"2026-08-08T05:00:39","slug":"benefeds-contractor-pays-31m-in-back-wages-benefits-to-employees","status":"publish","type":"post","link":"https:\/\/staging.sightlinemg.com\/federaltimes\/govcon\/regulations-govcon\/2023\/02\/24\/benefeds-contractor-pays-31m-in-back-wages-benefits-to-employees\/","title":{"rendered":"Benefeds contractor pays $3.1M in back wages, benefits to employees"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A California-based subcontractor that provides benefit enrollment support for federal workers shorted wages and benefits for 3,100 of its employees, a U.S. Department of Labor <a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/whd\/whd20230222-5\" target=\"_blank\">investigation<\/a> found.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alorica Inc., a customer service technology services provider that subcontracts to support federal dental and vision benefits, was found to have paid wages below what is called for by the Service Contract Act, a longstanding and complex regulation that sets a <a href=\"https:\/\/www.federaltimes.com\/2022\/07\/08\/gop-measure-would-stop-federal-contractor-minimum-wage-from-becoming-permanent\/\">floor for compensation<\/a> to protect workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cViolations under the Service Contract Act can be costly, as this case illustrates, but they are preventable with knowledge and due diligence,\u201d Wage and Hour Division Regional Administrator Mark Watson said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An investigation by the department\u2019s labor law enforcement arm determined that pay shortages occurred between January 2017 and March 2022. The main contractor, Long Term Care Partners LLC, now operating as Fed Point, paid out $3,193,839 to settle the violation. The company administers the federal Long Term Care Insurance Program and Benefeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alorica said it would audit its pay processes, according to the agency. Neither Alorica nor Fed Point responded to requests for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThroughout the course of the investigation, LTCP cooperated and ultimately paid all back wages and benefits owed to its subcontractor\u2019s employees,\u201d the department said.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/staging.sightlinemg.com\/federaltimes\/govcon\/contracting\/2022\/10\/27\/john-hancocks-fedpoint-wins-extension-of-contract-to-manage-benefeds\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"213\" src=\"https:\/\/staging.sightlinemg.com\/wp-content\/uploads\/2026\/08\/635596754849973667-afp-525114725jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">John Hancock\u2019s FedPoint wins extension of contract to manage Benefeds<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The contract, awarded after a competitive bidding process, will begin on Jan. 1.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The two companies are contracted by the U.S. Office of Personnel Management to power the government\u2019s online benefits marketplace.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Regulations hard to follow<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The Department of Labor also said this week it will be offering training sessions for agencies, contractors, unions and workers on the Service Contract Act and its equivalent for federally funded construction contracts, the Davis-Bacon Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An agency spokesperson told Federal Times these trainings are unrelated to any investigation, though it has noted heightened interest in prevailing wage regulations since the passage of the Bilateral Infrastructure Law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service Contract Act has been setting the minimums for wages and fringe benefits for employees on service contracts since 1965 and has been criticized for being outdated, inflexible and difficult to understand. The law\u2019s premise is to set minimum compensation standards across the board so that labor arbitrage would not hijack the bidding process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s unclear how many federal contracts are covered by this law, though it applies broadly to businesses performing services on government contracts in excess of $2,500. In 2021 alone, federal civilian agencies spent roughly <a href=\"https:\/\/gaoinnovations.gov\/Federal_Government_Contracting\/\" target=\"_blank\">$200 billion on services. <\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Experts in the contracting and legal professions have agreed that while the Service Contract Act is nothing new, it has been challenging for the buying agency and the contractor to understand, though strict compliance is expected and violations can be costly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the worst cases, a violation can result in a three-year debarment from future contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Department of Labor previously found violations in <a href=\"https:\/\/www.gao.gov\/products\/gao-21-11\" target=\"_blank\">nearly 70%<\/a> of Service Contract Act audits from 2014 to 2019, the Government Accountability Office found.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn light of recent investments in our nation\u2019s infrastructure, we see a great opportunity to educate employers so they can compete for new federal contract opportunities and put skilled employees to work in their communities,\u201d said Jessica Looman, principal deputy Wage and Hour administrator, in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>Current and former Alorica employees who worked on
